Hereinafter referred to as “SoPigalle”.
2. Purpose and scope
These Terms and Conditions of Sale, hereinafter the “Terms”, govern the sale of products made on the sopigalle.com website between SoPigalle and any adult natural person acting as a consumer, hereinafter the “Customer”.
They define in particular the conditions applicable to orders, prices, payments, deliveries, the right of withdrawal, returns, refunds and guarantees.
The Customer acknowledges having had the opportunity to review these Terms before confirming an order.
Any order implies acceptance of the Terms applicable at the time it is confirmed.
3. Adult customers
SoPigalle markets, in particular, sex toys, intimate accessories, wellness products, lingerie, lubricants, care products and other items intended for adult customers.
The sale of products relating to adult sexuality is reserved for persons aged 18 or over.
By placing an order, the Customer declares that they are of legal age and have the legal capacity required to enter into the contract.
SoPigalle may refuse or cancel an order where there is a legitimate reason to consider that these conditions are not met.
4. Products
The essential characteristics of the products are presented on their respective product pages.
Depending on the nature of the product, this information may include its dimensions, materials, colours, features, power supply, compatibility, package contents, precautions for use and manufacturer recommendations.
The Customer must review this information before placing an order.
Photographs and illustrations are intended to present the products as faithfully as possible.
Slight differences in colour, presentation or packaging may nevertheless exist, in particular due to the display settings of the device used or a change in presentation decided by the manufacturer, provided that these differences do not affect the essential characteristics of the product.
5. Availability
Products are offered subject to availability.
The availability displayed on the Website is updated as regularly as possible. An exceptional unavailability or stock synchronization error may nevertheless occur after an order has been confirmed.
In such a case, SoPigalle will inform the Customer as soon as possible.
Depending on the circumstances, SoPigalle may offer the Customer the option to wait for restocking, cancel the affected product and receive a refund, or accept a replacement product.
No replacement product will be shipped without the Customer’s prior agreement.
6. Prices
Product prices are stated in euros, including all taxes, unless otherwise indicated.
Any delivery charges are shown separately before final confirmation of the order.
The total amount payable is presented to the Customer before the order is confirmed.
SoPigalle may change its prices at any time. Products are nevertheless invoiced at the price applicable when the order is confirmed.
For certain deliveries made outside the European Union or to certain territories, customs duties, local taxes or import charges may be payable by the recipient where they are not included in the amount paid on the Website.
7. Promotions and discounts
Promotional codes, commercial offers and discounts are subject to the conditions specified when they are presented.
Unless otherwise stated, offers cannot be combined.
The application of a discount or promotional code does not deprive the Customer of their statutory guarantees or their right of withdrawal where applicable.
8. Orders
The Customer selects the products they wish to purchase, along with any variants, and adds them to the cart.
Before final confirmation, the Customer can check the selected products, quantities, prices, contact details, delivery address, delivery method and information required for payment.
The Customer can correct any errors before confirming the order.
Final confirmation of the order gives rise to an obligation to pay.
An order confirmation is then sent to the Customer by email.
It includes, in particular, the order number, the products ordered and the order amount.
9. Payment
Payment is due when the order is placed, except where a deferred or instalment payment solution is expressly offered.
The available payment methods are those presented at the payment stage.
Their availability may vary depending on the country, the amount of the order or the payment services enabled on the Website.
Payments are processed by secure payment service providers.
SoPigalle does not retain the Customer’s full bank card number.
An order may be refused or suspended in the event of a refused payment, manifestly incorrect information, reasonable suspicion of fraud or any other legitimate reason.
10. Delivery
SoPigalle delivers to the countries and territories offered during the order process.
The available delivery methods, related charges and estimated delivery times are presented to the Customer before final confirmation of the order.
The Customer must provide a complete, accurate and accessible address.
SoPigalle cannot be held liable for consequences resulting from an incorrect or incomplete address provided by the Customer.
A single order may be shipped in several parcels, in particular where products are prepared from different warehouses.
Unless otherwise indicated before the order is placed, shipment in several parcels does not result in additional delivery charges for the Customer.

11. Discreet packaging
Order confidentiality is an important commitment for SoPigalle.
Products are shipped in neutral outer packaging, carefully sealed and with no indication that could identify the nature of the products ordered.
The order contents and categories of products purchased are not explicitly shown on the outside of the parcel.
12. Receipt of the order
The Customer is invited to check the parcel upon receipt.
In the event of a missing, incorrect, damaged or visibly deteriorated product, the Customer must contact SoPigalle as soon as possible:
To facilitate processing of the request, it is recommended that the Customer provide the order number and, where relevant, photographs of the parcel, shipping label and affected product.
Prompt notification helps process the matter but does not deprive the Customer of their statutory rights and guarantees.
13. Right of withdrawal
As a general rule, a consumer Customer has a statutory period of 14 days from receipt of the product to exercise the right of withdrawal, without having to give a reason.
Where an order contains several products delivered separately, the period starts from receipt of the last product.
The Customer may exercise the right of withdrawal using the form at the end of these Terms or any other clear statement unambiguously expressing the wish to withdraw.

The Customer must communicate the decision before expiry of the statutory period and then return the relevant product within the applicable time limits.
Where an online withdrawal function is made available on sopigalle.com in accordance with applicable regulations, the Customer may also use that function to notify their decision.
14. Exceptions to the right of withdrawal and hygiene rules
The right of withdrawal does not apply in the cases of exclusion provided for by applicable regulations.
This includes, in particular, goods that have been unsealed by the Customer after delivery and that cannot be returned for reasons of hygiene or health protection.
Given the nature of certain products sold by SoPigalle, this exception may apply in particular to certain sex toys, intimate accessories, cosmetic products, care products or other items fitted with a seal, membrane or hygiene protection where that protection has been removed.
The mere fact that a product is a sex toy or an intimate product does not automatically remove the right of withdrawal.
Where the product remains sealed and satisfies the statutory return conditions, the right of withdrawal remains applicable.
Products made to the Customer’s specifications or clearly personalized may also be excluded from the right of withdrawal in the cases provided for by applicable regulations.
15. Returns
Before any return, the Customer must contact SoPigalle customer service to obtain the instructions applicable to the order and prior approval for the return.

The Customer must not send a product back spontaneously without first contacting SoPigalle and receiving the necessary instructions.
Returned products must be complete, properly protected for transport and accompanied by their accessories, cables, instructions and any other items supplied with the product.
Where the product has a seal, membrane or hygiene protection whose opening results in exclusion of the right of withdrawal, that protection must remain intact.
When exercising the right of withdrawal, direct return shipping costs are borne by the Customer, unless otherwise provided by law or expressly covered by SoPigalle.
After prior approval of the return by SoPigalle customer service, the relevant products must be shipped to the following logistics address:

This address is a logistics address for processing returns.
SoPigalle remains the seller and the Customer’s contractual point of contact.
The Customer must follow the instructions provided by SoPigalle and, where a reference or return number is provided, display it in accordance with the instructions received.
Sending a product directly to the logistics address without prior approval from SoPigalle may prevent or delay identification of the parcel and processing of the request.
It is recommended to use a tracked shipping method and retain proof of postage until the matter is closed.
For a defective, damaged, non-compliant or incorrectly supplied product, the Customer must also contact SoPigalle in advance to receive the appropriate instructions.

16. Commercial return policy up to 30 days
In addition to the statutory withdrawal period, SoPigalle allows, for eligible products and in accordance with its Refund Policy, a return request to be made up to 30 days after receipt of the order.
This option is an additional commercial benefit and does not in any way reduce the consumer’s statutory rights.
It remains subject to the conditions set out in the Refund Policy, in particular concerning the condition of the product, its packaging, accessories and applicable hygiene rules.
17. Refunds
Where the right of withdrawal is validly exercised, SoPigalle refunds the amounts due to the Customer in accordance with applicable statutory provisions.
The refund includes the standard delivery charges initially paid where required by applicable regulations.
Where the Customer selected a delivery method more expensive than the standard method offered by SoPigalle, the additional cost is not refunded where permitted by applicable regulations.
For the sale of goods, SoPigalle may defer the refund until the products have been recovered or until proof of their shipment has been received, under the conditions provided by law.
The refund is made using the same payment method as that used for the order, unless the Customer expressly agrees to another method that does not incur additional charges.
18. Defective, damaged or non-compliant products
Where a product is defective, does not correspond to the order or was damaged before being handed over to the Customer, the Customer must contact SoPigalle customer service.
To facilitate processing of the request, it is recommended to provide the order number, the affected product, a precise description of the issue and, where useful, photographs or a short video.
SoPigalle will then provide the Customer with the appropriate instructions.
Where the lack of conformity or defect falls within a statutory guarantee, the costs necessary to implement that guarantee are covered in accordance with applicable regulations.
19. Statutory guarantee of conformity
The Customer benefits from the statutory guarantee of conformity applicable to products sold by SoPigalle.
This guarantee is independent of any commercial guarantee that may be offered by a manufacturer.
SoPigalle remains the Customer’s point of contact for implementation of the statutory guarantee owed by the seller.
Depending on the applicable statutory conditions, the Customer may benefit in particular from repair or replacement of the product and, where the conditions provided by applicable regulations are met, a price reduction or termination of the sale.
Information relating to the statutory guarantee
Consumer rights under the statutory guarantee of conformity are exercised in accordance with Articles L.217-3 et seq. of the French Consumer Code.
The statutory guarantee of conformity applies independently of any commercial guarantee that may be granted.
The consumer also benefits from the guarantee against hidden defects under the conditions provided for in Articles 1641 et seq. of the French Civil Code.
20. Guarantee against hidden defects
The Customer also benefits from the guarantee against hidden defects provided for by the French Civil Code.
This guarantee concerns a hidden defect existing at the time of sale and sufficiently serious to make the product unfit for its intended use or to substantially reduce its usefulness.
Where the statutory conditions are met, the Customer may exercise the remedies provided for by applicable regulations.
21. Manufacturer commercial guarantees
Certain products may benefit from a commercial guarantee offered by their manufacturer.
Where such a guarantee exists, it is additional to the statutory guarantees and does not replace them.
The conditions, exclusions and duration of any commercial guarantee are those stated by the manufacturer.
SoPigalle remains the Customer’s point of contact for exercising the statutory guarantees owed by the seller.
22. Use and precautions
Products must be used in accordance with their intended purpose, the information on their product page, their instructions, warnings on their packaging and the manufacturer’s recommendations.
The Customer must in particular comply with recommendations concerning cleaning, maintenance, storage, charging and compatibility of products used together.
A damaged product or a product displaying abnormal operation must not be used.
Products must be kept out of reach of children.
Use must be stopped in the event of pain, irritation, injury, overheating or an unusual reaction.
The information and content provided on the Website are general and informative and are not a substitute for medical advice.
In the event of pregnancy, a medical condition, medical treatment, an implanted medical device or doubt concerning a possible contraindication, the Customer is advised to seek advice from a healthcare professional before using a product that may be concerned.
23. Liability
SoPigalle is responsible for proper performance of its contractual obligations under the conditions provided for by applicable regulations.
However, SoPigalle cannot be held liable where damage results in particular from misuse of the product, failure to follow its instructions, unauthorized modification or repair, fault by the Customer or an event meeting the statutory characteristics of force majeure.
No provision of these Terms is intended to exclude or limit any guarantee or liability that cannot legally be excluded or limited.
24. Force majeure
Neither party may be held liable for a failure directly caused by an event meeting the statutory characteristics of force majeure.
Where the impediment is temporary, performance of the relevant obligation may be suspended.
Where it becomes permanent, the order may be cancelled and unperformed services refunded in accordance with the applicable rules.
25. Personal data
Personal data collected when an order is placed may in particular be used for order, payment, delivery, return and after-sales service management, fraud prevention and compliance with SoPigalle’s legal obligations.

26. Intellectual property
Texts, photographs, illustrations, logos, videos, graphic elements and other content appearing on the Website may be protected by applicable intellectual property rules.
Any unauthorized reproduction, use or exploitation that may infringe the rights of their owners is prohibited.
Trademarks, visuals, photographs and content belonging to manufacturers, suppliers or partners remain the property of their respective owners.

28. Applicable law and dispute resolution
These Terms and sales concluded on the Website are governed by French law.
Where a Customer resides in another European Union Member State, the application of French law does not deprive the Customer of the mandatory consumer protection provisions available in their country of residence.
In the event of a dispute, the Customer is invited to contact SoPigalle customer service first in order to seek an amicable solution.
The rules relating to consumer mediation and the contact details of the mediator applicable to SoPigalle will be incorporated into these Terms once SoPigalle has finalized its membership of a consumer mediation scheme.
If no amicable solution is reached, the dispute may be brought before the competent courts in accordance with applicable legal rules.
29. Changes to the Terms
SoPigalle may amend these Terms to take account, in particular, of legal, regulatory, technical, commercial or organizational developments.
The Terms applicable to an order are those in force when the order is confirmed.
The date of the applicable version appears at the beginning of this document.
30. Special conditions
Certain product categories or services may be subject to special conditions supplementing these Terms.
SoPigalle gift cards are, in particular, subject to specific terms of use accessible on the Website.
Where such special conditions exist, they supplement these Terms for the products or services concerned.
31. Customer acceptance
Before confirming the order, the Customer must be able to consult these Terms.
Final confirmation of the order constitutes acceptance of the applicable Terms and gives rise to an obligation to pay.
The Customer may save or print these Terms for their records.
